License Agreement (Overview)

FX Elements requires its Users agree to its License Agreement.

 License valid forever

Once you license and download a file, you can use it in perpetuity. If you downloaded a file with a valid subscription, you could use it forever and ever, even after your subscription has expired.

 License for use, not to own

You are purchasing the right to use our clips, but FX Elements LLC remains the sole owner of the rights to the Content and the Website, inclusive of all intellectual property rights and all copyright.

 Unlimited projects

Use in as many projects as you like; the license is tied to you and/or your company, not to a particular project.

 Unlimited users within your organization

For all Studio level licenses and above. Licenses are based on your company's annual revenue, not on the number of users or seats.

 Worldwide use

Once you purchase a license, you can distribute your final project incorporating the file you licensed anywhere.

Common use cases

You can use our clips only as part of your projects.

Common permitted use cases include:

 Use in Film

In all venues, theatrical, DVD/Blu-ray, VOD, streaming, etc.

 Use in Television

All forms, broadcast, streaming, etc.

 Use in Games

All delivery formats and platforms, online, physical, etc.

 Graphic Design / Motion Graphics

All delivery formats and platforms, online, physical, etc.

 Countless other uses

Advertisements, presentations, animations, slides, etc.

Not Permitted

Here are a few of the most important limitations to know.

Common Limitations include:

No standalone use

You can use our clips only as incorporated into your project, not as a standalone file. You may not use our clips in any way that allows others to download, extract, or redistribute our content as a standalone file (meaning just the content file itself, separate from the project or end use).

No sharing or reselling

You cannot resell or share our clips. For example, you cannot download our elements and then use them to create a competing website or upload our elements to a third-party marketplace, such as an alternative stock footage site or an in-game marketplace.

No unlawful use

You may not use the Content in a pornographic, defamatory, or any other unlawful manner or in violation of any applicable regulations or industry codes. You may not use the Content in connection with any media project that could be considered libelous, obscene, insulting, racist, or immoral.

No Use in Trademarks or Logos

What about your clients and subcontractors?

You can create projects for your clients, but only you can download our clips and use them to create a project. You can transfer your project to your clients or subcontractors, but the License is only yours, and your clients or subcontractors may not use our content for any other purpose. You are responsible for their actions, and they have to comply with our License Agreement.

Provisions relating to our subscription option:

Plenty of downloads per day

The specific number of daily download credits depends on your subscription license type.

Royalty Free License

Even if your subscription ends, the license of the files you downloaded remains valid as long as you continue to comply with our License Agreement, of course.

No hoarding or attempting to download the entire library

We want you to download what you need as you need it. This option is not designed or intended to be used as a way to transfer our library to your local storage in bulk.

No use of bots or other automated means of downloading

We consider this to be an unreasonable use of our website, and therefore, it is prohibited.
